India’s hawkers’ (street vendors’) movement: A 50-year struggle continues

As India’s hawkers’ (street vendors’) movement for rights and welfare completes 50 years, here’s looking back at the long struggle for rights and some milestones, including the birth of National Hawker Federation (a national platform to collaborate efforts and push for a country-wide policy for vendors), its ongoing efforts and YUVA’s role in furthering rights.

Street Vending: From Early Times to Today

The history of street vending can be traced back to the ancient barter system used to exchange goods and services. Over time, the system evolved to include the exchange of money and the use of marketplaces at designated times and venues as places of business. ‘Natural markets’ grew organically and people congregated weekly, and then daily, to fulfill their needs. In contemporary times urbanisation, accompanied by increasing migration from rural areas in search of employment, resulted in the expansion of the informal sector. Additionally, the economic reforms in the 1990s, coupled with a stagnancy in formal jobs and a decline in the manufacturing sector, led to a sharp increase in the size of the informal economy — many who were previously employed in the organised sector were pushed to the unorganised sector.

सड़क पर माल बेचने (स्ट्रीट वेंडिंग) की कृति का इतिहास देखे तो हमें माल और सेवाओं के आदान-प्रदान के लिए उपयोग की जाने वाली प्राचीन वस्तु विनिमय (बार्टर) प्रणाली तक पीछे जाना होगा। समय के साथ, यह प्रणाली विकसित हुई और इस में धन का आदान-प्रदान प्रारम्भ हुआ। साथ ही साथ व्यापार के लिए विशिष्ट स्थानों पर और विशिष्ट समय पर बाजारों का उपयोग होने लगा। ‘प्राकृतिक बाजारों’ में काफी वृद्धि हुई और लोगों ने साप्ताहिक, और फिर दैनिक रूप से, अपनी आवश्यकताओं को पूरा करने के लिए ऐसी जगह पर इकट्ठा होना शुरू किया। समकालीन समय में शहरीकरण और साथ-साथ रोजगार की तलाश में ग्रामीण क्षेत्रों से बढ़ते स्थानान्तरण की वजह से इस अनौपचारिक क्षेत्र का विस्तार हुआ। इसके अतिरिक्त, १९९० के दशक में आर्थिक सुधार, औपचारिक नौकरियों में रुकाव और औद्योगिक (मैन्युफैक्चरिंग) क्षेत्र में गिरावट के कारण, अनौपचारिक अर्थव्यवस्था के आकार में तेजी से वृद्धि हुई। कई लोग जो पहले संगठित क्षेत्र में कार्यरत थे, उन्हें नौकरी जाने की वजह से अलग-अलग असंगठित क्षेत्रों में रोजी रोटी के विकल्प ढूंढना पड़ रहा था।

Street Vendors in Independent India: The Struggle for Rights and the Birth of NHF

Despite the sizeable presence and contribution of street vendors over the years, independent India criminalised street vending. Struggles and protests began across cities, with Kolkata, Mumbai and Delhi being the primary centres of agitation in the late twentieth century. Organised efforts resulted in the Supreme Court judgments of 1985 and 1989 that recognised the rights of citizens to earn their livelihoods using public spaces and expanded the understanding of the right to life to include the right to livelihood.

In 1997, Youth for Unity and Voluntary Action (YUVA) partnered with Tata Institute of Social Sciences (TISS) on a census survey of street vendors commissioned by the Brihanmumbai Municipal Corporation (BMC). An educational film ‘Saval Jine Ka’ (The Question of Survival) was released by YUVA during this time to spread awareness amongst street vendors regarding the ongoing efforts. Given the absence of a policy or legislation for street vendors, in 2000 YUVA (Mumbai), Hawkers Sangram Samiti (Kolkata) and other members and unions launched the National Hawker Federation (NHF), a national platform to collaborate efforts and push for a country-wide policy.

Efforts Towards the Adoption of the National Policy on Urban Street Vendors

In August 2001, the Ministry of Urban Development, formed a National Task Force to frame policy guidelines on street vending. NHF and YUVA played an important role in ensuring the participation and representation of street vendors in the national dialogue. This was the first task force created with a diverse representation of all stakeholders — from government representatives to street vendors and others.

NHF organised a South East Asia Convention in Kolkata, inviting national and international unions and organisations working with street vendors. Additionally, YUVA had commissioned a study in the Mumbai suburb of Nalasopara, published in 2005 as a model framework — ‘Integration of Street Vendors in the Development Plan’. The learnings from the convention and initial findings from the study guided NHF and YUVA’s recommendations to the task force. Finally, in 2004, the first National Policy on Urban Street Vendors was adopted.

अगस्त २००१ में, शहरी विकास मंत्रालय ने स्ट्रीट वेंडिंग पर नीति दिशानिर्देशों को बनाने के लिए एक राष्ट्रीय टास्क फ़ोर्स का गठन किया। इस संघर्ष में राष्ट्रीय स्तर पर हो रहे संवाद में स्ट्रीट वेंडरों का सहभाग और प्रतिनिधित्व सुनिश्चित करने में एनएचएफ और युवा ने महत्वपूर्ण भूमिका निभाई। सभी हितधारकों के — जैसे सरकारी प्रतिनिधियों से लेकर सड़क विक्रेताओं और अन्य लोग — ऐसे भिन्न प्रकार के प्रतिनिधित्व के साथ बनाया गया यह पहला टास्क फ़ोर्स था।

Challenges in Implementation of the National Policy on Urban Street Vendors and Demands for Better Legislation

NHF and YUVA focused on spreading awareness about and implementing the National Policy on Urban Street Vendors (2004) in states and municipal corporations by strengthening associations and collaborations. However, the non-binding nature of the policy and lack of political will to drive efforts resulted in poor or near-zero implementation of the policy in majority states.

एनएचएफ और युवा ने संस्थाओं और सहयोगों को मजबूत करके राज्यों और महानगरपालिकाओं में ‘शहरी स्ट्रीट विक्रेताओं पर राष्ट्रीय नीति (२००४)’ के बारे में जागरूकता फैलाने और उसे लागू करने पर ध्यान केंद्रित किया। हालांकि, नीति की गैर-बंधनकारक स्वरूप के कारण और इन प्रयासों को चलाने के लिए राजनीतिक इच्छाशक्ति की कमी के परिणामस्वरूप ज्यादातर राज्यों में नीति का अमल खराब या लगभग शून्य हुआ।

Concerted efforts by NHF, YUVA and supportive organisations and unions on policy awareness, advocacy and campaigning led to the revision of the National Policy in 2009 as well as the introduction of The Model Street Vendors (Protection of Livelihood and Regulation of Street Vending) Bill in the same year by the UPA government.

Advocating for Central Legislation and the Street Vendors Act, 2014

The National Policy 2009, although a major feat in the ongoing struggle of street vendors was not legally binding, resulting in poor implementation. To strengthen legislation further, NHF and YUVA focused attention from the states to the Centre and advocated for a policy for street vendors under the right to livelihood framework. In 2009–10, NHF–YUVA collaborated to review the implementation status of the National Policy and recommended the immediate approval of the Model Street Vending Bill 2009, by all states in their assemblies along with amendments to relevant laws, to legalise street vending. Suggestions for inclusion of street vendors in city planning processes, appropriate resource allocation, attention to their welfare, awareness generation on their rights, and their participation and employment with dignity were also enumerated in the report.

Simultaneously, e-commerce was gaining momentum in the country, adversely impacting the business of street vendors. NHF–YUVA contested this issue in the Parliamentary Committee and discussed the impacts of foreign direct investment (FDI) on small businesses in the country, campaigning for their protection. Finally in 2014, the Central Government enacted the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, which is legally binding on all state and local governments.

इसके साथ ही, देश में ई-कॉमर्स तेजी से बढ़ रहा था, जो सड़क विक्रेताओं के व्यवसाय पर प्रतिकूल प्रभाव डाल रहा था। एनएचएफ-युवा ने संसदीय समिति के साथ इस मुद्दे पर प्रतिवाद किया और देश में छोटे व्यवसायों के संरक्षण के लिए अभियान चलाते हुए इन छोटे व्यवसायों पर प्रत्यक्ष विदेशी निवेश (एफडीआई) के प्रभावों पर चर्चा की। आखिर साल २०१४ में, केंद्र सरकार ने “स्ट्रीट वेंडर्स (प्रोटेक्शन ऑफ लाइवलीहुड एंड रेगुलेशन ऑफ स्ट्रीट वेंडिंग) अधिनियम” लागू किया, जो सभी राज्य और स्थानीय सरकारों के लिए कानूनी रूप से बंधनकारक है।

Street Vendor Rights

Some of the rights guaranteed to street vendors under The Street Vendors Act of 2014 are:

  • Every street vendor has the right to carry on the business of street vending activities in accordance with the terms and conditions mentioned in the certificate of vending.
  • Every street vendor possessing a certificate of vending, in case of his relocation, is entitled for a new site or area, for carrying out his vending activities as determined by the local authority, in consultation with the Town Vending Committee. Incase of relocation or eviction, the vendor is to be given thirty days notice for the same.
  • Incase the goods of the vendor have been seized, the vendor can reclaim his goods after paying the fees specified in the scheme. The local authority is obligated to release the non-perishable goods within two working days and the perishable goods on the same day of the claim.
  • The Act mandates the formation of one or more independent Dispute Redressal Committees (DRCs) for the redressal of grievances or resolution of disputes filed by street vendors.
  • The Town Vending Committee (TVCs) in charge of enumerating, identifying and allocating vending zones requires atleast a 40 per cent representation from street vendors and another 10 per cent from community based or non-governmental organizations.
  • No limit has been defined on the number of licenses to be issued prior to the completion of surveys by the TVC, that are required to be conducted every five years. All vendors identified in the survey are to be accommodated, subject to holding capacity of the zone. Incase of exceeding the holding capacity, the vendors are required to be accommodated in adjoining locations.

२०१४ के स्ट्रीट वेंडर्स एक्ट के तहत स्ट्रीट वेंडर्स को गारंटी दिए गए कुछ अधिकार हैं:

  • प्रत्येक स्ट्रीट वेंडर को वेंडिंग सर्टिफिकेट में उल्लिखित नियम और शर्तों के अनुसार स्ट्रीट वेंडिंग गतिविधियों के व्यवसाय को चलाने का अधिकार है।
  • अगर कोई वेंडिंग प्रमाणपत्र धारण करने वाला स्ट्रीट वेंडर एक जगह से दूसरी जगह स्थानांतरित होता है तो ऐसा प्रत्येक स्ट्रीट वेंडर उसकी वेंडिंग गतिविधियों को करने के लिए एक नई साइट या क्षेत्र के लिए हकदार है। इस नई साइट या क्षेत्र का निर्धारण टाउन वेंडिंग कमेटी के परामर्श से स्थानीय प्राधिकारी द्वारा किया जायेगा। विक्रेता का उसकी मौजूद जगह से स्थानांतरण या निष्कासन करना हो तो, विक्रेता को इस लिए तीस दिन का नोटिस दिया जाना चाहिए।
  • अगर किसी विक्रेता का माल जब्त कर लिया गया है, तो वह विक्रेता योजना में निर्दिष्ट फीस के भुगतान के बाद अपने माल को पुनः प्राप्त कर सकता है। अपने सामान को वापस लेने के दावे के बाद गैर-खराब सामानों को दो कार्य दिवस और खराब होने वाले सामानों को उसी दिन जारी करने के लिए स्थानीय प्राधिकारी बाध्य है।
  • यह अधिनियम सड़क विक्रेताओं द्वारा दायर विवादों के निवारण या समाधान के लिए एक या एक से अधिक स्वतंत्र विवाद निवारण समितियों (डीआरसीज) के गठन को अनिवार्य करता है।
  • वेंडिंग जोन की गणना, पहचान और निर्धारण (एलोकेशन) के अधिकार प्राप्त टाउन वेंडिंग कमेटी (टीवीसी) में कम से कम ४० प्रतिशत स्ट्रीट वेंडरों का और १० प्रतिशत समुदाय आधारित या गैर-सरकारी संगठनों का प्रतिनिधित्व रहना आवश्यक है।
  • टीवीसी द्वारा सर्वेक्षण पूरा होने से पहले जारी किए जाने वाले लाइसेंस की संख्या पर कोई सीमा निर्धारित नहीं की गई है। यह सर्वेक्षण हर पांच साल में आयोजित करना आवश्यक है। सर्वेक्षण में पहचाने गए सभी विक्रेताओं को जोन की क्षमता के अधीन समायोजित किया जाना है। अगर विक्रेताओं की संख्या धारण क्षमता से अधिक हो तो विक्रेताओं को आस-पास के स्थानों में समायोजित किया जाना आवश्यक है।

Implementation Status of the Street Vendors Act, 2014, and Ongoing Efforts

While a comprehensive legal framework has been established, the struggle to ensure that street vendors can exercise their rights continues and effective Act implementation remains a challenge. NHF and YUVA continue to monitor law enactment and implementation. Their 2019 report, ‘The State Wise Analysis of Rules for the Implementation of the Street Vendors Act of 2014’ highlighted how:

  • Two States and four Union Territories (UT’s) had still not published the rules for implementing the Act, which formulates the first step towards implementation.
  • Dispute Redressal Committees (DRCs) had not been mentioned in the rules of several states, while others such as Tamil Nadu charged a steep fee of INR 500 to approach the DRC and Kerala had provision for a DRC only in the capital city.
  • Several issues were reported in the composition and functioning of Town Vending Committees such as inadequate representation of street vendors, non participatory methods of selection to the committee, lacking infrastructural support from states and so on.

स्ट्रीट वेंडर्स एक्ट, २०१४ के अमल की स्थिति और लगातार चल रहे प्रयास

जबकि एक व्यापक कानूनी फ्रेमवर्क स्थापित किया गया है, स्ट्रीट वेंडर अपने अधिकारों का उपयोग कर सकते हैं यह सुनिश्चित करने हेतु हो रहा संघर्ष और कानून का प्रभावी अमल करना चुनौती बना हुआ है। एनएचएफ और युवा कानून के अधिनियमन और अमल की निगरानी करना जारी रखते हैं। उनकी २०१९ की रिपोर्ट, ‘स्ट्रीट वेंडर्स एक्ट, २०१४ के अमल के लिए नियमों का राज्यवार विश्लेषण’ में नीचे लिखे मुद्दों पर प्रकाश डाला गया है:

  • कानून को लागू करने के लिए उसके नियमों को प्रकाशित करना उस कानून के अमल का पहला कदम होता है। परन्तु दो राज्यों और चार केंद्र शासित प्रदेशों (यूनियन टेरिटरीज) ने अभी भी कानून को लागू करने के लिए नियमों को प्रकाशित नहीं किया है।
  • विवाद निवारण समितियों (डीआरसीज) का कई राज्यों के नियमों में उल्लेख नहीं किया गया था, जबकि अन्य राज्य जैसे कि तमिलनाडु ने डीआरसी से संपर्क करने के लिए रु. ५०० का शुल्क निर्धारित किया था और केरल ने केवल राजधानी शहर में डीआरसी के लिए व्यवस्था उपलब्ध थी।
  • सड़क विक्रेताओं का अपर्याप्त प्रतिनिधित्व, समिति के चयन के गैर-सहभागी तरीके और राज्यों से बुनियादी सुविधाओं का अभाव इत्यादि और भी कई मुद्दों को टाउन वेंडिंग कमेटियों की संरचना और कार्यप्रणाली में बताया गया।
