A national campaign on Right to Adequate Housing
Why an Anti-Eviction Caravan?
With an aim to initiate and promote country-wide conversations and action on the issue of right to adequate housing, the Anti Eviction Support Cell (AESC) of Youth for Unity and Voluntary Action (YUVA) has started the nation-wide Zero Eviction Caravan: A Campaign on Right to Adequate Housing.
Beginning from Nagpur on 4 February 2019, the Caravan is journeying to 22 cities across 15 states, disussing the right to adequate housing in these urban centres and strengthening networks with communities, activists and lawyers in the process too. The caravan will build a dialogue on the right to adequate housing while building strategies to prevent forced evictions across cities in India. The campaign also aims to support the efforts of communities, activists, lawyers and civil society in their fight for adequate housing and against forced evictions of their homes and places of work. One of the major objectives of this Caravan is to develop a collective strength among local struggles through this effort.
The Right to Adequate Housing
The Constitution of India provides every citizen the right to a dignified life (Article 21), which includes the right to housing. Forced evictions of homes and workplaces are a violation of several fundamental, constitutional and universal human rights, including the right to adequate housing, right to livelihood and most importantly the right to life. With increase in incidents of forced evictions in the recent past, the question of right to adequate housing has increasingly gained significance for the urban poor.
Often the law is used as a recourse in cases of evictions — for instance, the filing of a writ petition to seek a stay on the eviction process. The stay, if successful, postpones the eviction. However, it does not secure the right to adequate housing. In the High Court of Delhi itself, there are more than 20 ongoing cases of evictions with pleas for a stay order in all of them. However, this does not mitigate the fear of eviction. Similarly, protest in such cases provides interim or long-term relief from forced evictions, but it does not secure right to adequate housing.
The Caravan: Schedule and Objectives
In the month of February itself, the Carvan has already journeyed through eight cities. In each city, the dialogue is furthered in partnership with city-based organisations or collectives working towards the right to adequate housing. Each city event is usually spread over two days and takes the form of discussions and capacity building workshops to better understand the right to adequate housing and ways of negotiating and responding to the threat of forced evictions.
Broadly, the main objectives of the Caravan are:
- Training and capacity building workshops to enhance understanding of the right to adequate housing for communities, activists and advocates across contexts.
- Building a network of community based organisations and activists working on housing rights in each city.
- Spreading awareness about the Anti Eviction Support Cell and how it can be accessed.
- Documenting cases of forced evictions — its nature, patterns and causes and impacts in cities.
- Developing an urban manifesto based on people’s needs in each city.

जीरो-इविक्शन ‘कारवां’: उपयुक्त आवास के अधिकार पर अभियान
उपयुक्त आवास के अधिकार को पूरी तरह से लागु करने के मुद्दे पर देशव्यापी चर्चा शुरू करने के लिए यूथ फ़ोर यूनिटी एंड वॉलुंटेरी ऐक्शन (युवा) की एंटी- इविक्शन सपोर्ट सेल ने ज़ीरो इविक्शन कारवाँ: उपयुक्त आवास के अधिकार पर अभियान की पहल की है। यह कारवाँ 4 फ़रवरी 2019 को नागपुर से शुरू हुआ है। इस अभियान के तहत यह कारवाँ क़रीब 15 राज्यों के 22 शहरों में विभिन्न स्थानीय समुदायों के प्रतिनिधि, कार्यकर्ताओं और वकीलों के साथ आवास के अधिकार को केंद्र में रखते हुए प्रशिक्षण कार्यशालाओं का आयोजन किया जाएगा। इस कारवाँ के महत्वपूर्ण पहलुओं में एक यह भी है कि उपयुक्त आवास के अधिकार पर बातचीत के माध्यम से भारतीय शहरों में जबरन बेदखली को रणनीतिक और प्रभावी तरीके से रोका जा सकता है। इस अभियान का उद्देश्य समुदायों, कार्यकर्ताओं, वकीलों और नागरिक समाज के प्रयासों को उपयुक्त आवास के लिए उनकी लड़ाई में मदद करना और लोगो को अतिक्रमण हटाने के नाम पर घरों और काम के स्थानों से बेदखल होने पे मजबूर करने के षड्यंत्र के ख़िलाफ़ संघर्ष का साथ देना है। इस प्रयास के माध्यम से स्थानीय संघर्षों के बीच एक सामूहिक ताकत विकसित करने की कोशिश भी की जाएगी।
भारतीय संविधान का अनुच्छेद 21 प्रत्येक नागरिक को गरिमा पूर्ण जीवन जीने का अधिकार देता है, जिसमें आवास का अधिकार भी उल्लेखनीय है। लोगों को जबरदस्ती उनके घरों, कार्य स्थलों से बेदखल करना उनके उपयुक्त आवास का अधिकार, जीविका का अधिकार तथा सबसे महत्वपूर्ण गरिमा पूर्ण जीने का अधिकार जैसे मौलिक, संवैधानिक और सार्वभौमिक मानव अधिकारों का घोर उल्लंघन हैं। हाल के वर्षों में शहरों में जबरन बेदखली की घटनाओं में वृद्धि के साथ समस्याएँ बढ़ती जा रही हैं। ऐसे समय में उपयुक्त आवास के अधिकार का महत्व और बढ़ गया है।
अक्सर जबरन बेदखली के मामलों में न्यायालयों में एक रिट याचिका दायर करने के माध्यम से बस्ती के बचाव का प्रयास किया जाता है। परंतु यह तरीका एक अस्थायी उपाय साबित होता हैं जिसमे आगे चल के याचिकाकर्ता आवास के अधिकार पर अपना दावा करने में असफल हो जाता है। अभी दिल्ली हाई कोर्ट में जबरन बेदखली के 20 से भी अधिक मुकदमे चल रहे हैं जिन पर अभी स्टे लगी हुई है। लेकिन इतना सब होने के बाद भी जबरन बेदखली का खतरा कम नहीं हुआ है। इसी प्रकार से धरना प्रदर्शन या पत्र-व्यवहार जबरन बेदखली के मामले में अस्थाई राहत तो दे देता है, लेकिन यह उपयुक्त आवास के लिए सुरक्षित अधिकार प्रदान नहीं करता है।
यह कारवां फरवरी और मार्च 2019 के महीनों के दौरान 25 शहरों में जाएगा। फ़रवरी 2019 के अंत तक यह कारवाँ 8 शहरों में यात्रा कर चुकी है। प्रत्येक शहर में आयोजित होने वाले कार्यक्रमों के द्वारा दो दिनों में जनसाधारण तक इस मुद्दे को फैलाने और उनके संघर्ष को सशक्त करने का प्रयास किया जाएगा। यह उपयुक्त आवास और बेदख़ली के समय संवाद तथा पैवरी के द्वारा कैसे आवास के अधिकार की रक्षा की जा सकती है इस के तरीक़ों को समझने का प्रयास करेगी। फलस्वरूप यह कारवां संघर्षों को बढ़ाएगा और भारत में उपयुक्त आवास के लिए लोगों की जरूरतों को पूरा करेगा।
उद्देश्य
1. समुदायों के प्रतिनिधि, कार्यकर्ताओं और अधिवक्ताओं के लिए उपयुक्त आवास अधिकारों के संदर्भ में प्रशिक्षण और क्षमता विकास के लिए कार्यशालाओं का आयोजन करना।
2. प्रत्येक शहर में समुदाय आधारित संगठनों और आवास अधिकारों पर काम करने वाली संस्थाओं तथा अन्य कार्यकर्ताओं का एक नेटवर्क बनाना |
3. एंटी एविक्शन सपोर्ट सेल के बारे में जागरूकता फैलाना और इसे कैसे उपयोग किया जा सकता है इसके बारे में लोगों को सशक्त करना।
4. प्रत्येक शहरों में जबरन बेदखली के मामले दर्ज करना और इसके प्रकृति, पैटर्न, कारण और प्रभाव का पता लगाना |
5. प्रत्येक शहर में लोगों की ज़रूरतों के आधार पर एक शहरी मुद्दों पर घोषणा पत्र विकसित करना।
हम उपयुक्त आवास के मुद्दे तथा ग़ैरक़ानूनी ज़बरन बेदख़ली के विरुद्ध साझे संघर्ष को सशक्त करने की माँग के लिए आप सब से साथ की अपेक्षा करते हैं।
